Terms and Conditions for Babysitters Partnering with Balia Referral Agency LLC and Lilli @ CareCal

1. Background Checks and Verification Requirements

• All babysitters are required to have a full background check completed prior to accepting any job placements through Balia Referral Agency LLC in partnership with Lilli @ CareCal.

• Babysitters must provide ID verification, have a minimum of 3 years of childcare experience, and submit 3 professional references related to childcare.

2. Background Check Payment and Reimbursement Policy

• Babysitters must pay the background check fee upfront at a cost of $49.00.

• A reimbursement of $49.00 will be provided as an accomplishment bonus after the completion of three (3) job assignments through the agency.

• If the babysitter does not complete 3 job assignments within 8 weeks, they forfeit the background check fee. This applies to sitters who reject job placements or fail to fulfill their commitments.

• In the event that no job requests are made for the babysitter within the 8-week timeframe, the background check fee will be reimbursed in the amount of $49.00.

3. Independent Contractor Status, Liability Disclaimer, and Employment Status

• All babysitters are classified as independent contractors and are not employees of Balia Referral Agency LLC or Lilli @ CareCal.

• Balia Referral Agency LLC and Lilli @ CareCal are not liable for any actions, incidents, or outcomes before, during, or after any job placements. This includes, but is not limited to, accidents, injuries, damages, or disputes arising between the babysitter and the family, or between the babysitter and Lilli @ CareCal.

• In no way is Balia Referral Agency LLC a co-employer of any kind. It is the babysitter's discretion and responsibility to investigate and choose job positions. Balia Referral Agency LLC provides the tools and connections to facilitate job placement but does not guarantee employment, job quality, or safety.

• By participating in this service, you agree to hold Balia Referral Agency LLC and Lilli @ CareCal harmless from any and all claims, damages, liabilities, and expenses that may arise from your interactions with families, job performance, or any other related activities.

4. Terms of Engagement and Performance Expectations

• Babysitters are expected to actively participate and accept job placements as they are made available through the platform.

• Failure to respond to job requests, rejecting job placements without valid reasons, or showing a pattern of unavailability may result in removal from our system and forfeiture of the background check fee.

• Babysitters have the right to cancel an accepted job if there is suspicious behavior or any other concerning reason that compromises safety.

• If a babysitter is unable to fulfill a job due to illness or other unforeseen circumstances, a minimum 24-hour notice is required so that the agency may provide a replacement sitter for the family.

• Babysitters are prohibited from driving children during sitter hours unless explicitly agreed upon by the agency and the family in writing.

• Babysitters are not permitted to bring any additional persons, including family, friends, or co-relations, to any job assignment.

• Smoking, vaping, and the use of any substances, including alcohol and drugs, are strictly prohibited during job assignments. Babysitters must maintain a substance-free environment while on duty. Random drug testing may be requested to ensure compliance with this policy.

5. Family Profiles and Communication

• Each family will have a profile that includes detailed information about the job, family expectations, and contact information. This profile will be available to babysitters once they have selected a position.

• Babysitters have the right to contact the family directly and may choose to communicate via phone or video call prior to accepting or beginning the job assignment.

6. Reviews and Feedback

• Babysitters and families have the right to write reviews about their experiences. Babysitters can review the positions and the families, while families can write reviews about the babysitters.

• All reviews will be shared with Balia Referral Agency LLC to maintain quality and address any concerns. However, these reviews will not be made public.

• Babysitters will have access to their account at all times and the ability to adjust their availability calendar as needed.

7. Code of Conduct and Professional Standards

• Babysitters are expected to maintain professionalism at all times, including punctuality, clear communication with families, and adherence to agreed-upon job requirements.

• Dress appropriately and adhere to any specific requests or guidelines provided by the family.

• A pattern of unprofessional behavior, including no-shows, lateness, or repeated cancellations, may result in termination from the platform.

8. Prohibition of Private Arrangements with Families

• Babysitters are strictly prohibited from making private arrangements or connections with families referred through Lilli or Balia Referral Agency LLC outside of the Lilli platform.

• If a sitter is found to have made plans with a Lilli family or Balia Referral Agency LLC family outside of the program, they may be subject to a booking fee fine equivalent to the number of days worked outside the platform.

• This policy is enforced to maintain the integrity of the agency’s referral system and to ensure compliance with all terms and conditions outlined by Balia Referral Agency LLC and Lilli @ CareCal.

9. Confidentiality and Non-Disclosure

• Babysitters are required to maintain the confidentiality of all information related to the families they work with, including addresses, schedules, and personal matters. Breach of confidentiality may result in termination from the platform and potential legal action.

10. Code of Conduct for Families

• Families are expected to provide a safe working environment, respect the sitter’s time, and ensure timely payments. Families should communicate clearly and treat sitters professionally at all times.

11. Payment Policies and Fees

• Babysitters are paid directly by families unless otherwise specified. It is the babysitter’s responsibility to confirm payment terms before accepting a job. Balia Referral Agency LLC is not responsible for payment disputes between sitters and families.

12. Emergency Procedures

• Babysitters should follow established emergency procedures, including contacting emergency services if necessary. All incidents should be reported to the family and the agency as soon as possible.

13. Health and Safety Compliance

• Babysitters must adhere to health and safety guidelines, including maintaining a clean environment, proper food handling, and complying with any health protocols specified by the family or agency.

14. Job Acceptance and Refusal Policy

• Sitters are encouraged to accept jobs that fit their skills and availability. Repeated refusals or last-minute cancellations without valid reasons may affect future job opportunities.

15. Technology Use and Profile Management

• Babysitters must keep their profiles updated, including availability and contact information. Misrepresentation or failure to maintain an accurate profile may result in disciplinary action.

16. Termination and Appeal Process

• Balia Referral Agency LLC reserves the right to terminate sitters for violations of these terms. Sitters may request a review of termination decisions, but reinstatement is at the sole discretion of the agency.

17. Acknowledgment and Consent

• By using the services of Balia Referral Agency LLC and Lilli @ CareCal, babysitters acknowledge that they have read, understood, and agree to abide by these terms and conditions. Failure to comply may result in removal from the platform.

18. Insurance Disclaimer

• Balia Referral Agency LLC does not provide insurance coverage for babysitters. Babysitters are encouraged to obtain personal liability or accident insurance as needed.

• Balia Referral Agency LLC and Lilli @ CareCal reserve the right to amend these terms and conditions at any time. Changes will be communicated to all registered babysitters.

21. Agreement to Terms

• By signing up and using the services of Balia Referral Agency LLC and Lilli @ CareCal, you acknowledge that you have read, understood, and agree to abide by these terms and conditions.
