Terms and Conditions for Families Using Balia Referral Agency LLC Services

1. Payment and Employment Status

• Families agree to pay babysitters at the market rate hourly pay for the services provided.

• Babysitters are classified as independent contractors. If a family exceeds $2,000 in payments to the same babysitter within a calendar year, the babysitter will be considered a W-2 employee in accordance with state laws.

• All payments to babysitters are made directly by the families. Balia Referral Agency LLC is not responsible for handling payments.

2. Booking and Cancellation Policy

• Families are responsible for selecting a suitable babysitter based on their needs within the Balia Referral Agency LLC system.

• Each booking incurs a non-refundable cost of $25.00 per sitter, payable to Balia Referral Agency LLC.

• Overnight care or event care requests will be subject to increased booking fees. The additional fees will be determined based on the nature and duration of the care required.

• Families must cancel bookings within a timely manner. Failure to provide adequate notice may result in the family being charged for the services as if the job had been completed.

• There are no refunds for services once booked, as it is the family's decision to sign up and select sitters based on availability and skill.

3. Background Checks and Additional Charges

• All sitters referred by Balia Referral Agency LLC have undergone a criminal background check that includes records for the past 7 years, including any aliases (AKA).

• Motor vehicle records and drug testing are not included in the standard background check. If a family requires these additional checks, they must request them prior to finalizing the sitter selection. Additional charges may apply for these services.

4. Direct Hiring and Agency Role

• Families acknowledge that they are directly hiring babysitters through the Balia Referral Agency LLC and Lilli @ CareCal platform.

• Balia Referral Agency LLC and Lilli @ CareCal are not co-employers of the babysitters. The agency provides a referral service only and is not responsible for the direct employment relationship or any employment-related obligations.

5. Confidentiality and Privacy

• Families agree to maintain the confidentiality of any personal or sensitive information about the babysitters and to use such information solely for the purpose of hiring and working with them.

• Balia Referral Agency LLC will protect families' data in compliance with privacy laws and regulations.

6. Dispute Resolution

• Any disputes between families and babysitters should be resolved directly between the parties. Balia Referral Agency LLC will not mediate or intervene in disputes.

• Families should report any issues or concerns to Balia Referral Agency LLC for record-keeping purposes, but resolution of disputes remains the responsibility of the involved parties.

7. Service Limitations

• Balia Referral Agency LLC is not responsible for the performance or conduct of babysitters beyond the referral process. The agency does not guarantee the outcome of any job placement.

8. Emergency Procedures

• In the event of an emergency involving the babysitter or children, families should immediately contact emergency services and follow any established protocols. Families should also notify the agency of any emergencies for record-keeping purposes.

9. Non-Solicitation Clause

• Families agree not to directly hire or engage babysitters outside of the Balia Referral Agency LLC platform. Violations may result in additional fees or suspension of services.

10. Health and Safety Standards

• Families are encouraged to ensure that babysitters adhere to health and safety standards, including maintaining a clean environment and following any specific health protocols.

11. Review and Feedback Mechanism

• Families may provide feedback or review babysitters through the Balia Referral Agency LLC platform. This feedback will be used by the agency to maintain service quality but will not be made public.

12. Service Modifications and Updates

• Families will be notified of any changes to the service or terms and conditions. Continued use of the service following such changes constitutes acceptance of the new terms.

13. Liability and Limitation of Responsibility

• Balia Referral Agency LLC is not liable for any claims, damages, or losses arising from the use of the service, including issues related to the performance of babysitters or the employment relationship.

14. Termination of Service

• Balia Referral Agency LLC reserves the right to terminate a family’s access to the service for violations of these terms or other reasons deemed appropriate. Families will be notified of termination and any applicable consequences.

15. Consent to Communication

• By using the service, families consent to receive communications from Balia Referral Agency LLC regarding their use of the service, including updates, reminders, and other relevant information.

16. Acknowledgment and Consent

• By using the services of Balia Referral Agency LLC, families acknowledge that they have read, understood, and agree to abide by these terms and conditions.

• Families consent to all terms outlined and recognize that failure to adhere to these terms may result in the suspension or termination of their access to the agency's services.

17. Changes to Terms and Conditions

• Balia Referral Agency LLC reserves the right to amend these terms and conditions at any time. Any changes will be communicated to all registered families.

18. Governing Law

• These terms and conditions are governed by and construed in accordance with the laws of [State]. Any legal disputes arising from these terms shall be resolved in the courts of [State].

• Families are encouraged to implement appropriate security measures when hiring a babysitter, including verifying the sitter’s identity and ensuring safe access to their home.

23. Feedback and Dispute Mechanism

• Families can formally submit feedback or report issues regarding the babysitter or the service through the Balia Referral Agency LLC platform. The agency will use this feedback to improve service quality.

24. Profile Creation and Matching

• Each family will be able to create a profile based on their specific needs, preferences, and requirements. The Balia Referral Agency LLC system will use this profile to match families with suitable caregivers based on availability and skill.

25. Booking Fees for Specialized Care

• Each booking incurs a non-refundable cost of $25.00+ per sitter.

• Overnight care or event care requests will be subject to increased booking fees. The additional fees will be determined based on the nature and duration of the care required.

26. Transportation Policy

• All sitters must have reliable transportation; however, sitters are not permitted to drive children during their position unless special requests have been accommodated and family has paid for a MV check to be performed on chosen sitter.

27. Agreement to Terms

• By signing up and using the services of Balia Referral Agency LLC, families confirm that they have read, understood, and agree to these terms and conditions.
